The case of the plaintiff as per the statement of claim is that he was dismissed from the service of the defendant, without being given fair hearing by the Panel of Investigation set up to investigate the allegation involving examinations malpractice leveled against him. The plaintiff was appointed a Higher Instructor by the defendant on 20/9/82, and he rose to the rank of a Departmental Examination Officer. He has put up various claims of housing and transport allowances etc.

In its defence the defendant asserted that the plaintiff was given every opportunity to defend himself before the Panel of Investigation.

Both parties adduced evidence which were evaluated by the learned trial Judge, who dismissed the claim of the plaintiff. Aggrieved by the decision he appealed.
